Booking conditions

Article 1 – Contract/Confirmation

A contract/confirmation is reserved exclusively for the use of the furnished rentals: Le Château, Le Pavillon de la Calèche, Le Pavillon de Chasse or both Pavilions together.

Under no circumstances may Château Portos – EI De Mey Yves, represented by Mr Yves De Mey, be held liable in the event that these terms are used in contracts by third parties and/or for purposes other than tourism.

Article 2 – Duration of stay

The undersigned client has entered into an agreement for a fixed length of stay, as indicated in the contract and signed by the client. Under no circumstances may the client claim a longer stay in the reserved accommodation.
The owner always reserves the right to terminate the confirmed stay prematurely. The owner may seek legal assistance at any time.

Article 3 – Contractual agreement

The booking only becomes effective upon receipt by the owner of a deposit corresponding to 30% of the total booking amount. Payment of this deposit constitutes full acceptance of the contract and of the general booking conditions, even in the absence of a handwritten signature.

A copy of the contract is sent to the client, who undertakes to keep a copy for reference.

Under no circumstances may the contract agreed between the parties benefit, even partially, any third party, whether natural or legal person, unless prior written approval is given by the owner.

Any breach of this clause will result in the immediate termination of the stay, attributable to the client, with no refund whatsoever. The full amount of the stay will remain due to the owner.

Article 4 – Withdrawal period

For reservations made by post, telephone, email or online, the client cannot benefit from a withdrawal period, in accordance with Article L121-20-4 of the French Consumer Code concerning, in particular, accommodation services provided on a specific date or for a specific period.

Article 5 – Cancellation by the client

In the event of cancellation of the booking by the tenant, the amounts already paid will not be refunded. These amounts will be retained as a fixed compensation for the loss suffered by the owner.

Tenants are strongly advised to take out cancellation insurance to protect themselves against unforeseen circumstances that may lead to cancellation or interruption of the stay. The tenant is invited to enquire with their insurance company or bank, as some home insurance policies or credit cards include such coverage.

Article 6 – Cancellation by the owner/manager

In the event that the owner cancels the stay, except in duly justified cases of force majeure, the owner undertakes to refund all sums paid by the tenant.

Article 7 – Arrival

The guest must arrive on the date and at the time stated in this contract. In case of late or delayed arrival, the guest must inform the owner. Additional fees may be charged if the guest arrives outside the specified times.

Article 8 – Payment terms

To confirm the booking, the tenant must pay a deposit equal to 30% of the total rental amount at the time of booking.

A second payment, also equal to 30% of the total amount, is required four (4) months before the beginning of the stay.

The balance must be paid no later than thirty (30) days before the arrival date.

Failure to meet these payment deadlines may result in the cancellation of the booking, with no refund of amounts already paid, which will remain due to the owner as fixed compensation.

Article 9 – Cleaning/bed linen/towels/electricity

Cleaning fees are mandatory and charged in addition to the rental price. The accommodation must however be left in a proper condition (clean dishes, bins emptied, furniture placed back).

In case of excessive dirt or damage, extra cleaning fees may apply, charged at €50 per additional hour, with a minimum of €150.

For the Pavilions
Mandatory cleaning fees are added to the rental price:
• The Carriage House Pavilion: €220
• The Hunting Pavilion: €190
• Both Pavilions together: included

Rental of bed linen, towels and household linen is available at €18 per person per stay.
Energy costs are calculated according to the meter reading, at €0.30 per kWh.

 

For the Château
Bed linen, towels and household linen are included.
Cleaning fees are included.

Article 10 – Security deposit

A security deposit is required to cover any damages, loss, deterioration or missing items noted at the end of the stay, including loss of keys or equipment.

The amount varies according to the accommodation and length of stay:
• Carriage Hous Pavilion or Hunting Pavilion: €750
• Both Pavilions rented together: €750
• Le Château: €3000

The security deposit must be paid before arrival (by bank transfer) and will be refunded within fourteen (14) days after departure, minus any amounts required for repairs or replacement of missing/damaged items.

In the event of significant damage or loss exceeding the deposit amount, the tenant remains liable for the difference, upon presentation of proof.

Replacing locks in case of lost keys will be charged based on the actual cost of the intervention.

Article 11 – Use of the accommodation

The client must take care of the holiday accommodation and its contents, as well as shared areas and equipment provided.

Article 12 – Number of guests

The contract is concluded for the maximum occupancy stated in the confirmation. If the number of guests exceeds this capacity, the owner may refuse additional persons.

Article 13 – Pets

Pets are strictly not allowed unless expressly authorised and confirmed by the owner, with an additional charge of €10 per pet per day. If this clause is not respected, the owner may refuse the stay and no refund will be granted. Not allowed in The Château.

Article 14 – Insurance

The client is responsible for any damage caused by them. The client must be insured under an appropriate insurance policy covering these risks.

Article 15 – Payment of additional charges

At the end of the stay, the client will receive a final invoice including any charges not included in the rental price. These must be paid before departure.

Article 16 – Disputes

Any complaint must be reported as quickly as possible.

Article 17— Inventory of furniture and movable property

1.Establishment of the inventory
Before the start of the rental period, an official inventory of the furniture and movable property of the Château de Cahuzac was drawn up by a bailiff. This inventory includes detailed descriptions and photographs of the items present in the rented property.

2.Contractual nature of the inventory
This inventory forms an integral part of the present rental contract. It may be consulted by the tenant upon arrival.

Acknowledgement and acceptance by the tenant
The tenant acknowledges having read the inventory and accepts the condition of the premises, furniture and equipment upon arrival, unless written reservations were made at the handover of the keys.

3.Departure inventory
At the end of the stay, the condition of the furniture and items will be checked and compared with the initial inventory. Any deterioration, damage or disappearance, except in duly justified cases of force majeure, will be charged to the tenant, who will be responsible for the cost of repairs or replacement.

4.Updates to the inventory
The inventory may be updated or completed at any time in the event of changes to the furniture, replacement of equipment or interior alterations. These updates will form part of the contract from the moment they are established.
